By placing a reservation, redeeming a promotional code, accepting delivery, or taking possession of any equipment provided by Moving With Motion, LLC ("Company"), you ("Customer") agree to be bound by the following Terms and Conditions.
1.Rental Package
Each standard rental includes:
- Twenty (20) reusable moving totes.
- Ten (10) calendar day rental period.
- No additional equipment is included unless specifically purchased or listed on the reservation.
2.Reservation Requirements
- Reservations are subject to equipment availability.
- Customers may reserve equipment 3 weeks in advance.
- The Company requires scheduling reservations at least three (3) weeks before the desired delivery or pickup date.
- While the Company may accommodate earlier requests when inventory permits, earlier reservations are not guaranteed.
- The Company reserves the right to refuse any reservation based on inventory availability or operational limitations.
3.Delivery
Delivery is optional.
Delivery Fee: $40.00
- Delivery is available only within thirty (30) miles of Colorado State University in Fort Collins, Colorado.
- Delivery includes curbside drop-off only.
The Customer may choose either:
- Contactless delivery
- Attended delivery
If contactless delivery is selected, the Company may leave the equipment at the designated location and photograph the completed delivery. The delivery photograph constitutes proof of delivery.
If the Customer requests an attended delivery and is unavailable during the scheduled delivery window, an additional $40 delivery fee will be charged for a return trip.
4.Pickup
Customer pickup is included at no additional charge.
If Company pickup is scheduled, the Customer agrees that:
- all totes will be empty,
- reasonably clean,
- accessible,
- and available during the scheduled pickup window.
Failure to make equipment available may result in a $40 failed pickup fee plus any applicable rental extension charges.
5.Rental Period
- The standard rental period is ten (10) calendar days beginning on the date of delivery or pickup.
- The Customer agrees to return all equipment before the rental period expires.
6.Automatic Rental Extensions
- If equipment is not available for return or pickup at the end of the rental period, the rental will automatically extend.
- Extensions are billed in seven (7) day increments.
Extension Fee: $2.00 per tote for each additional seven (7) day rental period.
For a standard twenty (20) tote rental, the extension fee is $40.00 per additional seven-day period.
The Company may automatically charge the payment method on file without additional authorization.
7.Equipment Condition
- The Customer acknowledges that all equipment is delivered in clean and functional condition.
- Any concerns regarding equipment condition must be reported within twenty-four (24) hours of delivery.
- If no report is received within twenty-four (24) hours, the equipment shall be presumed to have been delivered in acceptable condition.
8.Cleaning
Customers agree to:
- Empty all totes.
- Remove trash.
- Remove packing materials.
- Return totes in reasonably clean condition.
The Company sanitizes all totes between rentals. Normal dirt and ordinary wear are expected.
9.Damage
Normal wear and tear is acceptable.
The Customer is financially responsible for damage beyond ordinary use including but not limited to:
- Cracks
- Broken lids
- Broken hinges
- Melting
- Fire damage
- Permanent paint
- Permanent marker
- Intentional damage
- Structural damage
10.Missing Equipment
The Customer is responsible for all rented equipment until returned to the Company.
Replacement Cost: $25.00 per tote
Future replacement pricing for additional rental equipment will be published as those products become available.
11.Payment Authorization
A valid credit or debit card is required for every reservation, including reservations redeemed using promotional or Partner Program codes.
The Customer authorizes the Company to charge the payment method on file for:
- Delivery fees
- Rental extensions
- Failed delivery attempts
- Failed pickup attempts
- Missing equipment
- Damaged equipment
- Replacement charges
- The Customer is responsible for all applicable sales taxes, governmental fees, and other charges required by law that arise from the reservation, rental, delivery, or optional services selected during checkout.
- Any unpaid rental charges authorized under this Agreement
Redemption of a promotional or Partner Program code does not eliminate the requirement to maintain a valid payment method on file throughout the rental period.
12.Cancellations
Reservations may be cancelled without penalty prior to delivery or pickup.
13.Partner Program
Moving With Motion offers a Partner Program through which approved organizations may purchase promotional redemption codes for distribution to their customers or clients.
Eligible partners include, but are not limited to:
- Realtors
- Real Estate Brokers
- Apartment Communities
- Moving Companies
- Property Management Companies
- Other approved organizations
Partner purchases provide redemption codes only. The purchase of redemption codes does not create a rental agreement and does not reserve equipment.
Each redemption code:
- Is valid for three (3) years from the date of issuance.
- Is single-use.
- Has no cash value.
- May not be exchanged for cash.
- May not be resold without the written consent of Moving With Motion.
- May not be partially redeemed.
- Remains subject to inventory availability when redeemed.
Moving With Motion reserves the right to suspend or terminate any Partner Program account for misuse, fraud, or violation of these Terms.
14.Customer Redemption Codes
A rental agreement is created only when a recipient redeems a valid redemption code and completes the online reservation process.
Redeeming a code does not guarantee a reservation until:
- Reservation information has been completed;
- A valid payment method has been provided;
- The Customer has accepted these Terms and Conditions;
- The reservation has been confirmed by the Company.
Customer redemption codes:
- Expire one (1) year after being issued to the customer.
- Are valid for one reservation.
- Are non-transferable.
- Have no cash value.
- May not be exchanged for cash.
- Are subject to inventory availability.
- Must be redeemed through the Company's website.
15.Service Area
- Standard delivery service is available within thirty (30) miles of Colorado State University in Fort Collins, Colorado.
- Service outside this area is solely at the Company's discretion.
- Additional delivery charges may apply.
16.Customer Responsibilities
While equipment is in the Customer's possession, the Customer is responsible for:
- Theft
- Loss
- Damage
- Misuse
- Weather exposure
- Proper storage
- Securing the equipment
The Company assumes no responsibility for equipment after delivery until it has been returned to Company possession.
17.Ownership
All equipment remains the exclusive property of Moving With Motion, LLC. Rental does not transfer ownership or create any ownership interest.
Customers may not:
- Sell
- Transfer
- Rent
- Modify
- Paint
- Permanently mark
- Alter
any Company equipment.
18.Weather
The Company reserves the right to reschedule deliveries or pickups due to weather, road closures, emergencies, or unsafe operating conditions. Reasonable efforts will be made to accommodate scheduling changes. Weather-related delays do not waive applicable rental charges unless otherwise approved by the Company.
19.Property Access
Customer is solely responsible for providing safe and legal access to the delivery or pickup location. This includes:
- Parking
- HOA requirements
- Gate codes
- Building access
- Elevator access
- Curbside availability
Moving With Motion provides curbside service only.
20.Privacy
The Company collects customer information solely for purposes of:
- Processing reservations
- Processing payments
- Customer communication
- Fraud prevention
- Service improvement
Payment information is processed through secure third-party payment processors.
21.Website Usage
Submitting a reservation through the Company's website constitutes an electronic agreement to these Terms and Conditions. Electronic acceptance shall have the same legal effect as a handwritten signature.
22.Company Rights
The Company reserves the right to:
- Refuse service
- Cancel reservations
- Modify pricing
- Suspend customer accounts
- Refuse promotional codes
- Decline reservations
- Update these Terms and Conditions at any time
23.Assumption of Risk
The Customer assumes all risks associated with loading, unloading, transporting, storing, stacking, or otherwise using the rented equipment. The Customer is solely responsible for determining whether the equipment is appropriate for the intended use.
24.Limitation of Liability
To the fullest extent permitted by applicable law, Moving With Motion, LLC, its owners, officers, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the rental, delivery, pickup, possession, or use of the Company's equipment.
Without limiting the foregoing, the Company shall not be responsible for any injury, death, property damage, loss of personal property, delay, inconvenience, business interruption, lost profits, or other damages resulting from the Customer's use, misuse, storage, loading, unloading, transportation, stacking, or handling of the equipment.
If the Company is found liable notwithstanding the foregoing limitations, the Company's total aggregate liability shall not exceed the total rental fees actually paid by the Customer for the applicable reservation.
Nothing in this Agreement limits liability to the extent such limitation is prohibited by applicable law.
25.Governing Law
This Agreement shall be governed by and construed under the laws of the State of Colorado, without regard to its conflict of law principles. Any legal action arising from this Agreement shall be brought exclusively in the state or federal courts located in Larimer County, Colorado, unless otherwise required by applicable law.
26.Severability
If any provision of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
27.Entire Agreement
These Terms and Conditions constitute the entire agreement between the Customer and Moving With Motion, LLC regarding the rental of equipment and supersede all prior communications or understandings relating to the rental.
28.Reservation Confirmation
A reservation is not considered complete until the Customer:
- Redeems a valid code (if applicable);
- Selects available reservation dates;
- Provides all required contact information;
- Provides a valid payment method;
- Accepts these Terms and Conditions;
- Receives a reservation confirmation from Moving With Motion.
Moving With Motion reserves the right to decline or modify requested reservation dates based on inventory availability.
29.Expired Redemption Codes
Expired redemption codes have no cash value and will not be redeemed after expiration. Moving With Motion has no obligation to replace expired codes. Replacement of expired codes is solely at the Company's discretion.
30.Promotional and Discount Codes
The Company may issue promotional or discount codes from time to time. Unless expressly stated otherwise:
- Codes may not be combined.
- Codes have no cash value.
- Codes may not be sold.
- Codes may be revoked if obtained fraudulently.
- Codes remain the property of Moving With Motion.
Customer Acknowledgment
By checking the acceptance box during checkout, redeeming a promotional code, placing a reservation, or accepting delivery or possession of Company equipment, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
